But you can also ask someone that you know that has been in an accident how the lawyer that they had handled their case. Did they like how they handled it, did they like how they interacted with them. Lawyers are like everybody else, some are really responsive and others are not. I’ve had people tell me that they could not get their lawyer on the phone, wouldn’t call back for two or three weeks, or every time they called they got a different lawyer. I’ve never heard that from my clients because they always talk to me – 24 / 7, they text me after five, they text or call me on the weekends, they shoot me emails on the weekend, and I respond.

Go to the hospital, and then see your doctor to document the injuries from your accident. Follow up with whatever specialist or rehab they send you to. Go there religiously, worry about your health first. As you go there you will accumulate bills, the amount of bills you have and the extent and severity of your injury determines what the value of your case is. Also keep a record of all medical bills, all expenses that you paid, all co-pays, and any slings or other equipment that you purchased to help you get through this period.

Most attorneys charge a contingency fee basis. So It could be 33 1/3 percent all the way up to 50%. It’s going to depend on the severity of the injury and the liability in the accident.

Absolutely. If you have any kind of pain you need to go see a doctor and get it checked out. A lot of times when you are in an accident your adrenalin is pumping or you are in shock and you are not going to feel the full effect of the injury that you have. Its only later when you are home or going to sleep that you start to realize that you are in more pain than you thought you were. Because the shock has worn off. When you go to the hospital or see your doctor after an accident then any injury that you have is related to that accident. You go to the hospital or the doctor and I was in a car accident and this is how I’m feeling they are going to put that in their notes. That relates the accident to your injuries and then you need to follow up after with basically services after that. Whether they want you to come back in for a recheck or they want you to get an MRI’s. Whatever it is they want you to do. IF you don’t do it, when you say “ummm I’m ok I’m going to go home” and 30 days later you say your neck is hurting so I am going to see a doctor and well I can’t think of anything else that happened so it must be the car accident. The insurance company is going to say if you were hurt you would have gone to the doctor and you didn’t so you injury has to be something else and we are not going to pay it.

What should you do at a car accident or a car accident scene? First stop. Never leave the scene. Leaving the scene of an accident is a crime in most states. Call the police. Check yourself, check your passengers. Grab your cell phone, step out of your car, as you check on the other people turn your video on so you are recording, you want to record pictures of the automobile and the placement – how they are set up on the road – one behind the other – to the side you want to get copies of the skidmarks too. This is particularly important if you have to remove your car from the roadway. Lots of states say move your car to the side of the road if you have an accident. You also want to record any conversations with the driver who is at fault. A lot of times they will admit their at fault, say their at fault and then when the police get there they will lie and say something else. Happens all the time. If you go ahead and flip your phone to video mode, instead of picture mode, you can capture all of this. Also when you get out, try to get a picture or video of the person that’s driving the other car. It’s not unusual for the driver of the car to get out and say they weren’t driving, the passenger was. The police officer would have no idea as to who was driving if you didn’t have video or other witnesses to testify as to what was going on. After you do that, get what ever medical treatment you need, do to the hospital, self transport yourself there, and then call your lawyer and your insurance company.

What you should not say is the accident may have been your fault or you could have done something else. Do not take responsibility for the accident, it’s the other person’s fault. Do not say “well I had the last clear chance to avoid the accident” because then you may not get anything in a contributory negligence state such as Alabama. Do not tell the insurance adjuster that you are fine, or you feel good right after the accident. Tell them you don’t know, you’re not sure and you may need to get checked out. And then go to a doctor or hospital and get checked out.

You are in an accident and you are injured go to the hospital or see your doctor as soon as possible. IF you are having problems see the doctor. If you think you are having problems go to the doctor. First of all your health is the most important thing you will ever have and you cannot get it back once you’ve lost it. Second, you need to relate your injury to the accident. That means if you don’t go to the hospital for 30 or 45 days the assumption is that it didn’t hurt after the accident and that you injured yourself somewhere else. Go to the hospital, see the doctor and follow up with any specialist they send you to. If they send you to rehab go to rehab. If you have a serious physical problem your doctor is probably going to send you to rehab before they suggest surgery. Rehab is the least invasive alternative before they cut you open. Injured in an accident go to the hospital.

As soon as possible. Preferably within 48 or 72 hours. You really don’t need to talk to the insurance adjuster until you have talked to your lawyer and gone over the facts with your lawyer. And you’ve gotten a copy of the police report that normally takes 72 hours. The insurance company is going to try to jump on your case and give you a low ball offer because you’re not that bad and yet you haven’t even gotten your records from the hospital yet. Get your lawyer as soon as possible.

You are. You are responsible for your own medical bills. Now if you are the injured person and the other person was negligent you can go against their insurance in the future and reimburse your insurance company or reimburse you for medical expenses you paid out of pocket. But when you go to the hospital, you personally are responsible, and you have to get money from the other party either through settlement or the court system. It’s not going to happen overnight, it may take days, weeks, or even years to resolve your case. So, if you have insurance when you hit the hospital, pull out your health insurance card and use that.

Yes they will. That’s why you have health insurance. They may be entitled to subrogate or get their money back from the insurance company of the driver who is at fault. But yes they will pay your medical bills and you need to use that first.

The auto insurance of the other driver if liability is clear may offer to pay all the money they have on your medical bills but there may be nothing left for you for pain and suffering, lost wages, etc. Your insurance company, your health insurance company may take less money to be reimbursed than what was actually paid.
