Short Answer: A blood test usually requires a warrant, consent, or a recognized exception.
Explanation: Under Missouri v. McNeely, the natural dissipation of alcohol in the blood does not automatically create an emergency exception in every DUI case. Under Birchfield v. North Dakota, breath tests and blood tests are treated differently for Fourth Amendment purposes.
