What Is Public Intoxication Under Alabama Law?
Under Ala. Code § 13A-11-10, a person commits public intoxication if they are in a public place under the influence of alcohol or drugs and:
- Endanger themselves, another person, or property
- Engage in boisterous or offensive conduct that annoys others nearby
Key point: Being intoxicated alone is not enough. The State must prove conduct that meets the statute.
